Terms and Conditions of Hamilton Tours Ltd Bradford, Ontario

RESERVATIONS: All tours are booked directly through Hamilton Tours Ltd. office.

RATES: Tour rates are calculated according to transportation fares, and accommodation rates in effect as of January 2016. Although efforts are made to maintain the tour rates as published, Hamilton Tours Ltd. reserves the right to adjust prices at any time should this become necessary

DOCUMENTATION REQUIREMENTS: You have indicated that you are a Canadian Citizen.  Canadian Citizens are required to present a valid passport when travelling outside of Canada.  We require that you provide us with your Passport number & expiration date, your name as it appears on your passport and your birthdate for all international tours. Please note that entry into another country may be refused even if the required information and travel documents are complete. Living standards and practises at your destination may differ from those found in Canada. 

PRICE INCREASES: This contract permits price increases.  No price increases are permitted after the customer has paid in full.  If the price increase is more that 7% (except resulting from an increase in retail sales tax or federal Good and Services Tax or Harmonized Sales Tax), the customer has the right to cancel the contract and obtain a full refund.

DEPOSITS & PAYMENTS: Overnight Tours require a set deposit that is listed with the itinerary within 14 days of booking. If the deposit is not received within this time period, reservations may be cancelled. The balance of payment due date, is also listed with the itinerary therefore guaranteeing the confirmed rate. When reservations are received less than 45 days prior to departure, full payment is required immediately

FORMS OF PAYMENT: Hamilton Tours Ltd. accepts payment in the form of cheque, money order or cash. Cheques must be made payable to Hamilton Tours Ltd. A service charge of $25.00 will apply to any NSF cheques.

GOODS AND SERVICES TAX: G.S.T./H.S.T. charges, if any, that apply to the cost of your tour are included in the price.

CANCELLATION CHARGES: on Overnight Tours:
If you cancel - Overnight Tours
61 days or more - Deposit only
46 to 60 days - 50% Tour Cost
31 to 45 days - 75% Tour Cost
Day of departure to 30 days - 100% Tour Cost

TRAVEL INSURANCE: Hamilton Tours Ltd. strongly recommends the purchase of insurance for overnight tours. Our office offers travel insurance for tour and individual travel. Our exclusive insurance agent is RBC. We have a long-standing relationship with this company and know they can meet the need of our clients for health, cancellation and interruption insurance. Insurance is quoted on an individual basis and should be arranged and paid for at the time of booking. If insurance is declined, a RBC waiver must be signed and returned to our office prior to departure.

RESPONSIBILITY: Responsibility of Hamilton Tours Ltd., Bradford, Ontario.
Hamilton Tours Ltd. acts solely as organizer of the tours outlined in this brochure and are responsible for making all reservations and charting the routes as outlined. It is expressly understood and agreed between the tour organizer and the passengers that Hamilton Tours Ltd. shall not be held responsible for:
a) non-performance on the part of any hotel or other accommodation for any act or omission that cannot be directly attributed to the neglect of the tour organizer;
b) any delays, misconnections, loss, damage or injury to persons or property or for mechanical defects or failure, however caused for for any substitution of hotels or carrier equipment beyond the control of the tour operator; or for any additional expenses occured there by;
c) any inconvenience, loss of enjoyment, upset, disappointment, distress, or frustration whether physical or mental however caused, except where caused directly by the tour operator;
d) any additional costs incurred or any ancillary loss sustained as a result of cancellations or delays of tours caused by inclement weather conditions, acts of God, or any other event, which result in one of more persons being unable to continue or complete the tour through no direct fault of the tour organizer.

The tour organizer reserves the right to make any changes before or during the tour for the comfort and enjoyment of the passengers and it is agreed and understood that any increase in costs occasioned by such change shall be paid by the passengers or and decrease in costs occasioned by the change shall be refunded to the passenger.

All tour itineraries are subject to change or cancellation without prior notice. Hamilton Tours Ltd. shall have no responsibilities beyond their refund of all movies paid by the passenger, which is deemed to constitute full settlement.

The tour organizer reserves the right to decline any person as a member of the tour at any time before or during the tour should such person's presence be considered detrimental to the interest, comfort and enjoyment of the other tour members. Persons leaving the tour during operation will not receive a refund of unused services.

Hamilton Tours Ltd. and all passengers agree that the conditions set out herein are part of the terms between the passenger and the tour organizer. Acceptance of the ticket for the tour or any deposit given to the tour organizer will represent an acceptance by the passenger of all the aforementioned conditions.
